DISTANCE SALES CONTRACT. This contract is formed electronically, under Turkish Consumer Protection Law No. 6502 and the Distance Contracts Regulation, between the Seller identified below and the Buyer identified by the details you enter before payment. The Pre-Contract Information Notice is an integral part of this contract.
Article 1 - Parties. Seller: MASTER GLOBAL LOJİSTİK VE DIŞ TİCARET LİMİTED ŞİRKETİ (brand: Tossori). MERSIS no: 0613122894300001. Trade registry no: 122771-5 (İstanbul Ticaret Odası). Tax office / no: Beylikdüzü Vergi Dairesi / 6131228943. Registered address: Yakuplu Mah. Hürriyet Blv. Skyport Residence No: 1 İç Kapı No: 113, Beylikdüzü / İstanbul. Email: [email protected]. Phone: 0212 823 11 23. KEP (registered email): [email protected]. Buyer: the consumer identified by the name, contact, delivery and billing details entered before the payment step; these are kept in your order record.
Article 2 - Subject. The subject of the contract is the sale and delivery of the product(s) the Buyer orders electronically. The product name, colour, size, quantity, price including taxes, delivery charge and total amount payable are as stated in the order summary shown before payment, which forms an integral part of this contract.
Article 3 - Formation and payment obligation. The Buyer confirms having read and been informed by the Pre-Contract Information Notice and this contract, and presses the "Complete payment" button on the payment step; from that moment the Buyer is obliged to pay. The contract is formed once payment is confirmed by the payment provider; the order is not final before that.
Article 4 - Price and payment. The price, including taxes (VAT), is the total amount shown in the order summary before payment. Payment is taken by credit/debit card through the PayTR secure payment infrastructure. No charge is requested beyond the amount shown, and no option creating an additional payment obligation is pre-selected without the Buyer's explicit consent.
Article 5 - Delivery and performance. The product(s) are shipped by carrier to the delivery address in Türkiye entered by the Buyer. Orders are handed over to the carrier no later than 2 business days following payment confirmation. Carrier delivery times may vary depending on the delivery address and operational conditions. The Seller performs within the period it has committed to, and in any case within 30 days from the date the order reaches it. If performance does not occur in time the Buyer may terminate the contract, and the Seller refunds all payments collected, including delivery costs, with statutory interest within 14 days of the termination notice reaching it. If supply of the product becomes impossible, the Seller notifies the Buyer in writing or on a durable medium within 3 days of learning of it and refunds all payments within 14 days at the latest; being out of stock is not treated as impossibility.
Article 6 - Right of withdrawal. The Buyer may withdraw within 14 days of delivery without giving any reason and without penalty, and may also withdraw between formation of the contract and delivery. Notice is given to the Seller in writing or on a durable medium before the period ends (address and channels in the Pre-Contract Information Notice). The Buyer sends the product back within 14 days of the notice to the return address, unless the Seller offers to collect it. Return costs and refund terms are as in items 7 and 8 of the Pre-Contract Information Notice: refunds are made within 14 days of the returned product reaching the Seller (or, if the Buyer withdraws before delivery, of the notice reaching the Seller), including delivery costs, in one payment to the same payment method. The exceptions in Art. 15 of the Distance Contracts Regulation are reserved; none is foreseen for the apparel covered by this contract.
Article 7 - Risk of loss. The Seller is liable for loss and damage until the product is delivered to the Buyer or to a third party (other than the carrier) designated by the Buyer. If the Buyer asks for shipment with a carrier other than the one designated by the Seller, the Seller is not liable for loss or damage arising after handover to that carrier.
Article 8 - Defective goods. If the delivered product does not conform to the contract, the Buyer may choose, under the relevant provisions of Law No. 6502, a refund, a free replacement, a proportionate price reduction or (where feasible) free repair. These rights are independent of the right of withdrawal, and the Buyer's other statutory rights are reserved.
Article 9 - Force majeure. Events beyond the parties' control that were unforeseeable and prevent performance (natural disaster, epidemic, government action, extraordinary disruption to transport/logistics infrastructure, etc.) constitute force majeure; neither party is liable for non-performance for the duration of such an event. This article does not limit the Buyer's statutory rights.
Article 10 - Intellectual property. The Tossori brand, site content, imagery and design elements belong to the Seller or its licensors; no right in them, other than the purchased product, is transferred to the Buyer.
Article 11 - Personal data. Personal data is processed in line with the Personal Data Notice (KVKK). Accepting this contract is not an explicit consent under personal-data-protection law; permission for commercial electronic messages is separate and optional.
Article 12 - Dispute resolution. Disputes may, within the monetary thresholds set each year, be brought before the Consumer Arbitration Committee at the place of residence of the consumer or the seller, and above those thresholds before the Consumer Courts.
Article 13 - Records and evidence. The parties agree that the electronic records kept in the Seller's systems - including the order record, the accepted document versions and the time of acceptance - constitute valid evidence within the meaning of Article 193 of the Turkish Code of Civil Procedure (Law No. 6100). The Seller retains the information and documents on information, withdrawal, delivery and other obligations as required by the Regulation; you can access this contract from your order page.
Article 14 - Effect. This contract takes effect once electronically confirmed by the Buyer and payment is confirmed by the payment provider, and remains in force until the ordered performance is fully completed.
